Advertising Terms & Conditions

1. Basis of Contract

1.1. In these conditions the “Advertiser” shall mean any person, partnership, company and/ or its agent placing orders for the insertion of an advertisement in the publication provided by Scene Media.

2. Content of Advertisements

2.1. The Advertiser warrants that the placing of an order for the insertion of an advertisement in any Scene Media publication will:

2.1.1 not contain any material that may infringe any copyright or trademark.

2.1.2 comply with the British Code of Advertising Practice.

3. Payments

3.1. ALL payments are to be made in advance and shall be paid no later than seven days after the invoice date.

3.2. Late payments may result in the advert being removed from the issue concerned.

3.3 The existence of a query on any item in an account will not affect the due date of payment of the balance of the account.

3.4. Scene Media reserves the right to charge interest on any monies due which are in arrears and unpaid. Such interest will be calculated on the amount owing at a rate equivalent to 5% above the base rate of Lloyds Bank in the UK at the time being in force.

3.5. In addition to interest mentioned in point 3.2 above we may also exercise our right under the Late Payment of Commercial Debts [Interest] Act 1998 to charge recovery costs of £50.

3.6. Any queries or disputes relating to any invoice issued by Scene Media must be raised by the Advertiser within 7 days of receipt otherwise the invoice will be deemed accepted.

3.7. Advertisement rates are subject to increase at any time without notice to the Advertiser. Advertisers have the option to cancel without surcharge or continue at the revised rates.

3.8. Where the advertiser has undertaken to supply material for an advertisement and such material fails to arrive at the agreed time, place or is in an unsuitable condition for insertion, Scene Media reserves the right to charge the full rate agreed.

3.9. Charges may be made where the Advertiser supplies an advertisement which requires additional production work to make it suitable for insertion.

4. Liability and Indemnity

4.1. Scene Media will not be liable for any loss or damage, direct or consequential, occasioned by error in the insertion of or omission to insert any advertisement, or for late or early publication of an advertisement except in cases where Scene Media can be shown to be negligent in which case compensation may be negotiated up to a maximum of the cost of the space booked and paid by the Advertiser.

4.2. Scene Media will not be liable for damage or loss of material supplied for the purposes of an advertisement.

4.3. Scene Media will not be liable for any loss or damage occasioned by the non publication or cancellation of any issue.

4.4. Scene Media will not accept any responsibility for loss of circulation or ineffectiveness of any advertisement owing to circumstances beyond its direct control.

5. Distribution

5.1. Scene Media contracts distribution of The Scene magazines to an external distribution company. Distributors are GPS tracked to ensure comprehensive distribution in the majority of our stated areas.

5.2. Scene Media does not imply a 100% coverage to the said area, nor can it guarantee distribution to any particular property in that area. The stated distribution objectives and overall quantity distributed are for guidance only and Scene Media will make reasonable endeavours to achieve them. 

6. Cancellation

6.1. All cancellations of orders must be received no less than 2 weeks before the Copy Deadline. Scene Media reserves the right to charge the full rate agreed if cancellation is received after this deadline.

6.2. If the Advertiser cancels the balance of a contract (except in the case set out in clause 3.7 above) they relinquish any right to any series discount or free design to which they were previously entitled. Any discount to which the Advertiser benefitted from during the cancelled contract may become due.
